1. Overview

The website www.valourier.com is operated by KSO Ventures LLC, a limited liability company registered in the State of Florida, United States, doing business as Valourier (“Valourier,” “we,” “us” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products and services (the “Services”). By visiting the site or buying from us, you agree to these Terms and to the policies referenced in them, including our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use the Services.

Our store is hosted on Shopify. Shopify provides the e-commerce platform that allows us to offer our products to you.

2. Eligibility

You must be at least the age of majority in your country, state or province of residence to place an order, or have the consent of a parent or guardian who agrees to these Terms. You may not use the Services for any illegal or unauthorized purpose.

3. Products and descriptions

We make every effort to display our products, colors and images accurately. Colors may vary slightly depending on your screen, and sizes and measurements may vary within normal manufacturing tolerances. Product descriptions, sizing information and delivery estimates are part of the offer you accept when you buy. If a product you receive is not as described, your remedies are set out in our Refund Policy and in the law of your country.

4. Prices and currency

Prices are shown in U.S. dollars (USD) or in the local currency of your region, and you are charged in the currency shown at checkout. Prices shown to customers in the United Kingdom and the European Union include VAT. If your card is in a different currency, your bank may charge a currency conversion fee.

Prices, products and promotions may change without notice, but changes will not affect orders already confirmed. Occasionally, our site may contain errors in pricing, descriptions or availability. We reserve the right to correct errors and to cancel orders affected by a clear error, even after an order is placed. If we cancel your order, we will notify you and refund any payment in full.

5. Orders

Your order is an offer to buy. Your payment is charged when you place the order, and we accept the order when we send your shipping confirmation. We may refuse or limit any order, for example orders that appear to be placed by resellers or that are flagged as potentially fraudulent. If we cancel an order after you have been charged, we will refund you in full to your original payment method.

6. Payment

We accept the payment methods shown at checkout. Payments are processed by Shopify Payments and other third-party payment providers. By submitting your payment, you confirm that you are authorized to use the payment method and that the information you provide is accurate. The charge will appear on your statement as VALOURIER. Applicable taxes are calculated at checkout.

7. Shipping, returns and refunds

Shipping times, costs, duties and delivery terms are described in our Shipping Policy. Returns, refunds, cancellations and the right of withdrawal for UK and EU customers are described in our Refund Policy. Both are part of these Terms. Risk of loss passes to you when the order is delivered to the shipping address you provided. We ship only to the countries available at checkout, and we do not sell or ship to countries or persons subject to U.S., UK or EU sanctions or export restrictions.

8. Accounts

If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Contact us right away if you suspect unauthorized use.

9. Reviews and submissions

If you post reviews, comments, photos or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display that content in connection with the Services. You are responsible for your content and confirm that it is truthful and does not violate anyone’s rights. We may remove content that is unlawful, offensive or that violates these Terms. We do not edit reviews to change their meaning, and we do not pay for or suppress reviews based on whether they are positive or negative.

10. Third-party links and tools

The Services may include links to third-party websites or tools that we do not control. We are not responsible for their content, products or practices. Your use of them is at your own risk and subject to their terms.

11. Prohibited uses

You may not use the Services to: break any law; infringe our or anyone else’s intellectual property; harass, abuse or harm others; submit false or misleading information; upload viruses or malicious code; collect other users’ personal information; scrape or crawl the site without permission; interfere with the site’s security; or commit fraud, including fraudulent chargebacks.

12. Intellectual property

The Services and their content, including text, graphics, logos, images, product designs and the Valourier name, are owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce or use them without our written permission.

13. Disclaimer of warranties

Except as expressly stated in these Terms or our Refund Policy, and to the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. This section does not affect any statutory rights you have as a consumer, including the legal guarantee for goods in the UK and EU, which cannot be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Valourier and its owners, employees, partners and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Services or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded under applicable law, including your rights under consumer protection laws.

15. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Valourier and its owners, employees and partners from claims, losses and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms or your violation of any law or third-party rights.

16. Dispute resolution and governing law

If you have a concern, please contact us first at support@valourier.com. Most issues can be resolved quickly this way. These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Florida, unless it qualifies for small claims court.

If you are a consumer in the United Kingdom or the European Union, you also benefit from any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country. Nothing in this section prevents you from contacting your card issuer or a consumer protection authority.

17. Termination

We may suspend or end your access to the Services if you violate these Terms. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitation of liability and indemnification, will survive.

18. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms and the policies referenced in them are the entire agreement between you and us regarding the Services.

19. Changes to these Terms

We may update these Terms by posting a new version on this page. Changes apply to orders placed after the update. Continuing to use the Services after a change means you accept the updated Terms.
